DirectStay Terms and Conditions

1. Acceptance of Terms

By accessing or using the DirectStay website, mobile application, or services (collectively, the “Platform”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you must refrain from using our Platform.

2. Platform Overview

DirectStay provides a marketplace facilitating direct bookings between property hosts (“Hosts”) and guests (“Guests”). DirectStay does not own or manage rental properties and acts solely as an intermediary platform.

3. Account Registration

  • You must be at least 18 years of age to register an account.
  • You agree to provide accurate, current, and complete information during registration and to update this information as necessary.
  • You are solely responsible for safeguarding your account credentials.

4. Bookings and Payments

  • Guests agree to pay the full amount displayed at the time of booking, including applicable taxes and fees.
  • Payments are processed securely via DirectStay’s designated payment processor.
  • Hosts agree to honor all confirmed bookings at the agreed-upon price and terms.

5. Cancellations and Refunds

  • Cancellations and refund policies are set individually by Hosts and clearly displayed on each listing.
  • Guests must review and acknowledge cancellation terms before booking.
  • Refunds, when applicable, are issued according to the cancellation policy in effect at the time of booking.

6. Return & Refund Policy

  • For Hosts (Service Subscribers)

    Monthly Plan

    • DirectStay charges no fees unless a booking occurs.
    • The monthly service fee is non-refundable once charged.

    Annual Plan

    • Hosts who purchase an annual membership may request a full refund within 30 days of purchase.
    • After 30 days, no refunds will be issued for the remainder of the term.
    • To prevent automatic renewal, cancellation must be requested at least 30 days prior to the renewal date.
    • No partial refunds are provided for unused time if canceled after the refund window.

    Cancellation Process

    • Cancellation requests must be submitted through your DirectStay account dashboard or by written notice to DirectStay Support.
    • The date of the request will determine eligibility for refunds or renewal prevention.

7. User Conduct

Users must:

    • Use the Platform responsibly and in compliance with all applicable laws and regulations.
    • Refrain from fraudulent, abusive, or inappropriate behavior.
    • Not upload, distribute, or share content that is offensive, defamatory, unlawful, or infringes on the rights of others.

8. Intellectual Property Rights

  • All content and materials provided by DirectStay are protected by copyright, trademark, and other intellectual property laws.
  • Users may not reproduce, distribute, modify, or create derivative works without explicit written consent from DirectStay.

9. Liability Disclaimer

  • DirectStay disclaims all liability for disputes between Hosts and Guests.
  • DirectStay is not liable for any personal injuries, damages, losses, or claims arising from the use of properties booked via the Platform.
  • Users agree to indemnify and hold harmless DirectStay from all claims arising from their use of the Platform.

10. Third-Party Links

  • The Platform may contain links to third-party websites or services not operated by DirectStay.
  • DirectStay is not responsible for the content, accuracy, or practices of any third-party websites.

11. Termination

DirectStay reserves the right to suspend or terminate user accounts at its sole discretion for violations of these Terms or for any conduct detrimental to the Platform or other users.

12. Changes to Terms

DirectStay may update these Terms from time to time. Updates will be published on the Platform, and continued use after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which DirectStay is registered, without regard to conflict-of-law principles.

14. Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall first be attempted to resolve amicably. If unresolved, disputes shall be settled through binding arbitration under the applicable rules in the jurisdiction where DirectStay operates.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
